{"id":3169,"date":"2026-02-17T08:52:10","date_gmt":"2026-02-17T08:52:10","guid":{"rendered":"https:\/\/servehrindia.com\/?p=3169"},"modified":"2026-02-17T08:56:04","modified_gmt":"2026-02-17T08:56:04","slug":"legal-update-esi-coverage-of-educational-medical-institutions","status":"publish","type":"post","link":"https:\/\/servehrindia.com\/?p=3169","title":{"rendered":"Legal Update : ESI Coverage of Educational &#038; Medical Institutions"},"content":{"rendered":"<div id=\"pl-gb3169-6a157973c3a8a\"  class=\"panel-layout\" ><div id=\"pg-gb3169-6a157973c3a8a-0\"  class=\"panel-grid panel-no-style\" ><div id=\"pgc-gb3169-6a157973c3a8a-0-0\"  class=\"panel-grid-cell\" ><div id=\"panel-gb3169-6a157973c3a8a-0-0-0\" class=\"so-panel widget widget_text panel-first-child panel-last-child\" data-index=\"0\" ><h3 class=\"widget-title\">ESI Coverage of Educational &#038; Medical Institutions<\/h3>\t\t\t<div class=\"textwidget\"><ol>\n<li><strong> Background<\/strong><\/li>\n<\/ol>\n<p>The Employees\u2019 State Insurance Corporation (ESIC), Regional Office, Mumbai, has issued a <strong>Revised Circular dated 12.02.2026<\/strong> concerning the proposed extension of ESIC coverage to <strong>Educational and Medical Institutions employing 10 or more persons in Maharashtra<\/strong>.<\/p>\n<p>This circular is issued in continuation of an earlier circular dated 11.02.2026 and refers to a notification published by the Government of Maharashtra extending the provisions of the <strong>Employees\u2019 State Insurance Act, 1948<\/strong> to such institutions.<\/p>\n<ol start=\"2\">\n<li><strong> Legal Development<\/strong><\/li>\n<\/ol>\n<p>The Government of Maharashtra has subsequently informed ESIC that:<\/p>\n<p>&#8211; The <strong>Employees\u2019 State Insurance Act, 1948 stands repealed<\/strong>, and<\/p>\n<p>&#8211; The <strong>Code on Social Security, 2020<\/strong> has come into force with effect from <strong>21.11.2025<\/strong>.<\/p>\n<p>In view of the repeal of the ESI Act, the State Government has initiated action to <strong>cancel the notification<\/strong> issued under Section 1(5) of the ESI Act, 1948, as the legal basis for such notification no longer exists.<\/p>\n<ol start=\"3\">\n<li><strong> Directions Issued by ESIC<\/strong><\/li>\n<\/ol>\n<p>Based on the directions of the Government of Maharashtra, ESIC has instructed <strong>all field offices<\/strong> to:<\/p>\n<p>&#8211; <strong>Keep in abeyance the implementation<\/strong> of the said notification, and<\/p>\n<p>&#8211; <strong>Suspend all further action<\/strong> under the notification until further orders are issued<\/p>\n<ol start=\"4\">\n<li><strong> Compliance Implications for Employers<\/strong><\/li>\n<\/ol>\n<ol>\n<li><strong>a) ESIC Registration<\/strong><\/li>\n<\/ol>\n<p>&#8211; Educational and Medical Institutions are <strong>not required to obtain ESIC registration<\/strong> based solely on the stayed notification.<\/p>\n<ol>\n<li><strong>b) ESIC Contributions<\/strong><\/li>\n<\/ol>\n<p>&#8211; There is <strong>no obligation to commence deduction or payment of ESIC contributions<\/strong> pursuant to this notification.<\/p>\n<ol>\n<li><strong>c) Returns, Records &amp; Inspections<\/strong><\/li>\n<\/ol>\n<p>&#8211; No ESIC returns, declarations, or compliance actions are required under this notification.<\/p>\n<p>&#8211; Any enforcement action initiated exclusively under this notification is required to be <strong>kept in abeyance<\/strong>.<\/p>\n<ol>\n<li><strong>d) Existing Coverage<\/strong><\/li>\n<\/ol>\n<p>&#8211; Institutions <strong>already covered under ESIC for other valid reasons<\/strong> (e.g., factories or previously notified establishments) remain <strong>unchanged and fully compliant<\/strong> under existing law.<\/p>\n<ol start=\"5\">\n<li><strong> Forward-Looking Consideration<\/strong><\/li>\n<\/ol>\n<p>While the present notification has been stayed, employers should note that:<\/p>\n<p>&#8211; The Government may issue a <strong>fresh notification under the Code on Social Security, 2020<\/strong> covering Educational and Medical Institutions.<\/p>\n<p>&#8211; Such notification, if issued, may introduce <strong>new thresholds, definitions, or compliance requirements<\/strong>.<\/p>\n<p>Employers are therefore advised to maintain readiness in terms of employee data, wage records, and contractual arrangements, without taking any immediate compliance action.<\/p>\n<ol start=\"6\">\n<li><strong> Recommendation<\/strong><\/li>\n<\/ol>\n<p><strong>Employers are advised to take note of the circular and maintain status quo with respect to ESIC compliance. No new ESIC registration or contribution is required at present based on the stayed notification.
