{"id":3112,"date":"2025-12-03T09:17:52","date_gmt":"2025-12-03T09:17:52","guid":{"rendered":"https:\/\/servehrindia.com\/?p=3112"},"modified":"2025-12-03T09:17:52","modified_gmt":"2025-12-03T09:17:52","slug":"legal-update-factories-act-amendment-maharashtra","status":"publish","type":"post","link":"https:\/\/servehrindia.com\/?p=3112","title":{"rendered":"Legal Update &#8211; Factories Act Amendment &#8211; Maharashtra"},"content":{"rendered":"<div id=\"pl-3112\"  class=\"panel-layout\" ><div id=\"pg-3112-0\"  class=\"panel-grid panel-no-style\" ><div id=\"pgc-3112-0-0\"  class=\"panel-grid-cell\" ><div id=\"panel-3112-0-0-0\" class=\"so-panel widget widget_text panel-first-child panel-last-child\" data-index=\"0\" ><h3 class=\"widget-title\">Factories Act Amendment &#8211; Maharashtra<\/h3>\t\t\t<div class=\"textwidget\"><p>Dear All,<\/p>\n<p>In continuation of our earlier email pertaining to Maharashtra Factories (Second Amendment) Rules, based on the notification, Below are the key changes &#8211;<\/p>\n<p><strong>1<\/strong>. <strong>Digitalization of Processes<\/strong><br \/>\n&#8211; Applications, notices, and licenses must now be submitted <strong>electronically<\/strong> in prescribed forms (Form 1 and Form 4).<br \/>\n&#8211; Renewal and amendments of licenses will also be processed online.<\/p>\n<p><strong>2.<\/strong> <strong>Stability Certificate<\/strong><br \/>\n&#8211; For non-hazardous factories, the <strong>certificate of stability (Form 1A)<\/strong> must be submitted within <strong>12 months<\/strong> of license issuance.<\/p>\n<p><strong>3.<\/strong> <strong>Updated Fee Schedules<\/strong><br \/>\n&#8211; <strong>Schedule A<\/strong> (all factories except power stations) and <strong>Schedule B<\/strong> (power generating stations) revised with new fee structures effective from<strong> 2026.<\/strong><\/p>\n<p><strong>4.<\/strong> <strong>Medical Examination<\/strong><br \/>\n&#8211; Annual <strong>free medical check-up<\/strong> for workers aged <strong>45 years and above<\/strong>.<br \/>\n&#8211; Conducted by qualified practitioners or authorized medical officers.<br \/>\n&#8211; Results to be submitted electronically in <strong>Form 7-A<\/strong> within 15 days.<\/p>\n<p><strong>5.<\/strong> <strong>Safety &amp; Security for Women Workers<\/strong><br \/>\n&#8211; Women allowed to work <strong>7:00 PM to 6:00 AM<\/strong> with conditions:<br \/>\n&#8211; Adequate transport facilities.<br \/>\n&#8211; Well-lit workplace and amenities.<br \/>\n&#8211; Minimum two women workers per worksite.<br \/>\n&#8211; CCTV surveillance with 45-day recording.<br \/>\n&#8211; Written consent retained for 3 years.<\/p>\n<p><strong>6. Additional Safety for Pregnant &amp; Lactating Women<\/strong><br \/>\n&#8211; Prohibited from hazardous operations involving carcinogenic or teratogenic substances.<br \/>\n&#8211; Mandatory protective gear (respirators, masks, overcoats).<br \/>\n&#8211; Training on hazards and emergency escape routes.<\/p>\n<p><strong>7.<\/strong> <strong>Mock Drills<\/strong><br \/>\n&#8211; Every factory must conduct <strong>mock drills<\/strong> for emergency scenarios <strong>at least once every six months<\/strong> and report to the Inspector within 15 days.<\/p>\n<p><strong>8.<\/strong> <strong>Forms &amp; Documentation<\/strong><br \/>\n&#8211; <strong>Form 1<\/strong>: For new factory construction, registration, license grant\/renewal\/amendment, notice of occupation, manager change.<br \/>\n&#8211; <strong>Form 4<\/strong>: Electronic factory license.<br \/>\n&#8211; <strong>Form 7-A<\/strong>: Health register for workers (except hazardous processes).<\/p>\n<p><strong>9<\/strong>. <strong>Deleted Rules &amp; Forms<\/strong><br \/>\n&#8211; Rule 11 and Form 5 removed.<br \/>\n&#8211; Schedule XIII deleted.<\/p>\n<p>&#8212;<\/p>\n<p><strong>Objective<\/strong><br \/>\nThe amendments aim to:<br \/>\n&#8211; <strong>Digitize compliance<\/strong> for ease and transparency.<br \/>\n&#8211; <strong>Enhance worker health and safety<\/strong>, especially for women and vulnerable groups.<br \/>\n&#8211; <strong>Update fee structures<\/strong> and operational norms in line with current industrial practices.<\/p>\n<p>In reference to the above, Points 4 &amp; 7 require regular administrative compliance which is to be done by you.
